Nevada Requires Payment for Each Hour Worked

Overview

NRS 608.016 is Nevada’s core “hours worked” statute. Employers must pay wages for each hour the employee works and may not require unpaid trial or break-in periods.

Current Rule and Recent Changes

Through October 31, 2029, the statute expressly excludes certain time carved out by sections 2 and 4 of the federal Portal-to-Portal Act and listed FLSA regulations. Beginning November 1, 2029, that federal-exclusion language drops out and the statute returns to a simpler pay-for-each-hour-worked rule, subject to the remaining Nevada exceptions.

Separately, if employees may not bring or wear required uniforms or personal protective equipment from home, donning and doffing that gear is compensable under the current version of NRS 608.016.

Employee Rights

  • Pay for time worked at the employer’s direction, including work outside scheduled hours under NAC 608.115.
  • No unpaid training or trial period.
  • Travel between worksites during the workday is generally compensable under NAC 608.130.

Exceptions

Sleep periods under NRS 608.0195 and certain domestic-service agreements under NRS 608.215 may exclude specific periods from wages when the statutory conditions are met. The current temporary Portal-to-Portal language also matters for preliminary and postliminary activity disputes until November 1, 2029.

Practical Steps

  • Write down start and stop times, including required pre-shift or post-shift tasks.
  • Keep photos or copies of policies requiring on-site uniforms or PPE.
  • Compare unpaid tasks against NRS 608.016 and NAC 608.115 before filing a claim.
