Nevada Overtime Pay Requirements and Exceptions

Overview

NRS 608.018 sets Nevada’s overtime structure. Employees paid less than one and one-half times the minimum wage generally receive overtime after 40 hours in a workweek or after 8 hours in a workday, unless they mutually agree to a 4×10 schedule. Employees paid at least one and one-half times the minimum wage generally receive overtime after 40 hours in a workweek.

Employee Rights

  • Time-and-a-half for covered overtime hours.
  • Daily overtime protection for many employees paid below 1.5× minimum wage.
  • Compensatory time may not substitute for overtime wages under NAC 608.125.

Important Exceptions

NRS 608.018(3) lists many exclusions, including certain executive, administrative, and professional employees; outside buyers; some commissioned retail or service employees; CBA-covered employees with different overtime terms; many motor-carrier, railroad, and air-carrier employees; taxicab or limousine drivers; agricultural employees; businesses under $250,000 annual gross sales; certain auto sales or service roles; and some live-in domestic workers with written agreements.
