How Nevada Employees Can Recover Unpaid Wages

Employees have several recovery paths. Minimum-wage underpayments may be sued under NRS 608.260 within two years. Final-pay violations under NRS 608.020 to 608.050 may be sued under NRS 608.135 within two years. In ordinary wage suits, NRS 608.140 can award a reasonable attorney’s fee if the employee made a written demand at least five days before suit for no more than the amount later found due.

Many workers begin with a Labor Commissioner wage claim. If you file a civil action for the same wages under NRS 608.135, the Labor Commissioner will not take jurisdiction while that case is pending. Choose the forum strategically and keep all deadlines.
