Nevada Waiting-Time Penalties for Late Final Pay

Overview

If an employer fails to pay a discharged employee or an employee placed on nonworking status within three days after wages become due, or fails to pay a resigning employee on the day wages are due, wages continue at the same rate until paid or for 30 days, whichever is less.

NRS 608.050 provides additional daily-wage and lien remedies in certain termination nonpayment situations. NRS 608.135 authorizes a civil action within two years for violations of NRS 608.020 to 608.050. The Labor Commissioner will not take jurisdiction of a wage claim while a civil action for the same wages is pending.
