Final Pay After Discharge or Nonworking Status in Nevada
Overview
NRS 608.020 requires immediate payment of earned and unpaid wages when an employer discharges an employee or places the employee on nonworking status. Nonworking status means a temporary layoff where the employee remains employed and may be called back, and it does not include suspension pending investigation, disciplinary suspension, on-call status, or an approved leave of absence.
Employee Rights
Wages earned through the discharge or nonworking-status date become due at once. Delayed payment can trigger waiting-time penalties under NRS 608.040.
Practical Steps
- Request your final paycheck and an itemized wage statement in writing.
- Note the exact discharge or layoff date and any remaining unpaid hours, commissions, or bonuses already earned.
- Preserve texts, emails, and termination paperwork.
