Nevada Minimum Wage Rights for Employees
Overview
Nevada’s minimum-wage floor comes from Section 16 of Article 15 of the Nevada Constitution and is implemented through NRS Chapter 608. After voters approved Ballot Question 2, the constitutional rate became a flat $12 per hour beginning July 1, 2024, regardless of whether the employer offers health benefits.
Who Is Covered
Most private employees in Nevada are covered, including full-time, part-time, temporary, and probationary workers. Independent contractors are not covered for minimum-wage purposes under NRS 608.255. Certain trainees, minors, and other narrow categories may be treated differently under Labor Commissioner regulations.
Employee Rights
- You must be paid at least the applicable Nevada minimum wage for each hour worked.
- Tips may not be credited against Nevada’s minimum wage under NRS 608.160.
- If you are paid less than the minimum wage, NRS 608.260 allows a civil action within two years for back pay, damages, reinstatement or injunctive relief, plus attorney’s fees and costs if you prevail.
A contract accepting a lower wage does not bar a minimum-wage claim.
Exceptions and Limits
NRS 608.250 still contains historical dual-rate language tied to health benefits, but the constitutional amendment controls the current statewide floor of $12 per hour. Always confirm the rate and any limited regulatory exceptions with current Labor Commissioner materials before relying on older charts.
